NOTICE OF DEFICIENCIES AND IRREGULARITIES

SUPPORTED BY DECLARATION OF Alphonso-Nicholas Faggiolo

 

I, a man, Alphonso-Nicholas Faggiolo, a creation or God Almighty [not the COMMONWEALTH OF PENNSYLVANIA], now serve "Notice of Claim, Trespass, Forgery, Fraud, Barratry". In, its present Form, the attached document evidences crimes, deficiencies, irregularities, and is non-compliant with State and Federal Constitutions Andrew Goldberg [Trespasser], has three [3] days upon receipt to cure all deficiencies and irregularities; failure to do so this Claim of $100,000 shall execute upon Default against Andrew Goldberg, for Administering my property without right. I, a man, Alphonso-Nicholas Faggiolo, have personal knowledge or and asseverate the following.

1.   “COMMONWEALTH OF PENNSYLVANIA”: is a corporate fiction, an IT. I, a man, am not owned by IT, am not a citizen of IT, have no obligations [contracts] with IT, and do not reside in IT.

 

2.   “COUNTY OF DELAWARE” is a corporate fiction, an IT I, a man, am not owned by IT, am not a citizen of IT, have no obligations [contracts] with IT, and do not reside in IT.

 

3.    “Coat of arms” an unidentified symbol, resembling the Pennsylvania coat or arms, which “is not used in the official capacity of the state seal” [a corporate symbol]. Neither symbol [coat of arms or state seal] confer any distinction in law.

 

4.    "Rescheduling Notice": My body, all that I own and claim, is my exclusive Property. I, a man...Alphonso-Nicholas Faggiolo, am not Property of Andrew Goldberg [public servant], have no obligation [contract] with Andrew Goldberg: Andrew Goldberg is Administering Property without right.

 

5.    "Mag. Dist. No. MDJ-32-2-46": is a corporate fiction, an IT, created by other men and women [public servants]. I, a man, have no obligation [contract] with IT, or the men and women who created and manage IT, nor is it a Court of Record and therefore cannot be a Court of Pennsylvania.

 

6.    "Honorable Andrew Goldberg": In America, the courts of common law know no such distinction [Honorable] It is needless to add, that as we are not encumbered by a nobility, there is no such distinction [Honorable] in America, as all men being equal in the eye of the law.

 

7.    "COMMONWEALTH OF PENNSYLVANIA'': is a corporate fiction, an IT, not an adversary [litigant]. IT can't act, IT can't make and move a Claim. IT has no rights. IT can't be done wrong or harm, IT can't have personal knowledge of a matter, IT can't testify, and IT can't have Standing against I, a man: Alphonso-Nicholas Faggiolo.

 

8.    "Alphonso Faggiolo": Andrew Goldberg [public servant] filing and/or moving this action in the name of a corporate fiction [COMMONWEALTH OF PENNSYLVANIA] against I, a man...Alphonso-Nicholas Faggiolo; commits Trespass, Forgery, Fraud, Barratry.

 

9.    "Alphonso Faggiolo: I, a man...Alphonso-Nicholas Faggiolo am not Property of any man, woman, CORPORATION: have no contract with any man, woman, CORPORATION, cited in the attached document. The use of my identity constitutes Trespass, Forgery, Fraud, and Identity Theft, as Andrew Goldberg (public servant) is using my identity without my consent, without probable cause, and without just cause, in an effort to extort, and do wrong and harm; to I, a man...Alphonso-Nicholas Faggiolo.

 

10.    Docket No: MJ-32246-TR-0001106-2020”: This evidences Trespass, Forgery, Fraud, and Barratry; as noted in paragraphs 7 and 8.

 

11.    "Case Filed: 3/412020": This evidences Trespass, Forgery, Fraud, and Barratry; as noted in paragraphs 7 and 8.

 

12.    "Comp/Cit#: C 6317916-3": This evidences Trespass, Forgery, Fraud, Barratry; as noted in paragraphs 7 and 8. In addition this constitutes Securities Fraud, as a document was Forged and falsified in the name of a corporate fiction [COMMONWEALTH OF PENNSYLVANIA] by a public servant, who represented IT to be a valid commercial instrument [obligation/contract], in an attempt to extort money from I, a man...Alphonso-Nicholas Faggiolo; through the unlawful use of force, threat, and duress.

 

13.    “Your Role: Defendant": This evidences Trespass, Forgery, Fraud, and Barratry, as noted in paragraphs 7 and 8. It constitutes an unlawful attempt to lower my Status from that of a man [above -a-Magisterial Judge] to that of a Defendant [below a Magisterial Judge]. It also constitutes an unlawful attempt by this court not of record" to gain jurisdiction, when no such jurisdiction exists, nor can it ever exist, as there is no probable cause, nor is there a man or woman [litigant] who filed a verified Claim; so there exists no litigant or Controversy to defend against.

 

14.    I have no obligation [contract] to acknowledge, believe, adhere to, written instruments ["75 § 4703 §§ A (Lead) Operat Veh W/O Valid lnspect”] authored by other men and women [public servants]. I, a man...Alphonso-Nicholas Faggiolo, am not Property of the men and women [public servants] who authored the foregoing written instruments.

 

15.    "A Summary Trial was previously scheduled on June 4, 2020 I 8:45 AM in the above-captioned case. It has been rescheduled to be held on/at:" I, a man, Alphonso-Nicholas Faggiolo appeared on June 4, 2020 8:45 AM at Magisterial District Court 32-1-28, Media; with Verified Claims, Criminal Complaints, and Affidavits in hand; to be served to all [public servants] responsible [liable] for initiating and perpetrating, Trespass, Forgery, Fraud, and Barratry; against I, a man. Said court was CLOSED on June 4, 2020 8:45 AM, and Defaulted on any alleged Claim before it. Said court never notified I, a man… Alphonso-Nicholas Faggiolo; of the CLOSURE beforehand, and is now liable for (4) hours of my time; billed at a rate of $500/hour, $2,000 in total. [Bill to said court attached].

 

16.    "Date, Time, Place": I, a man...Alphonso-Nicholas Faggiolo am not Property of the public servant that "rescheduled", nor do I have an obligation [contract] to appear at the noted Date, Time, and Place. I, a man; have right to be justly compensated for my time. I, a man; require (a) an Appearance Fee of $10,000 paid five (5) days in advance of any requested Appearance, (b) I, a man; require the existing bill of $2,000 [attached] be paid five (5) days in advance, and (c) I, a man; require the findings of fact and conclusions of law Andrew Goldberg [public servant] relies on to ignore now Defaulted Affidavit of Fact, served to the alleged/unknown moving party on (date), via certified mail # 0000000000000.

 

17.    "Place: Magisterial District Court 32-1-28": Is an Improper Venue and Improper Court, as "Every court of Pennsylvania shall be a court of record with all the qualities and incidents of a court of record at common law"...{cf. 42 Pa.C.S.A. § 321}. Said court is not a court of record, therefore by definition cannot be a court of Pennsylvania.

 

Common Law: "The common law is that which derives its force and authority from the universal consent and immemorial practice of the people. It has never received the sanction of the legislature, by an express act, which is the criterion by which it is distinguished from the statute law".

 

Court of Record qualities: a) proceeds according to the common law{not statutes or codes}, b) tribunal is independent of the magistrate, c) power to fine or imprison for contempt, d) keeps a record of the proceedings. e) generally, has a seal.

 

18.    "Continuance requested by Magisterial District Judge Andrew Goldberg": I, a man...Alphonso-Nicholas Faggiolo; am not Property of Andrew Goldberg [public servant], and have no obligation [contract] with Andrew Goldberg. Andrew Goldberg has no jurisdiction, no standing, and no personal knowledge, of any matter concerning I, a man...Alphonso-Nicholas Faggiolo. This evidences Andrew Goldberg Trespassing and Administering my Property without right.

 

19.    "Reason: Other": Andrew Goldberg fails to state probable cause. I, a man… Alphonso-Nicholas Faggiolo; am not Property of Andrew Goldberg [public servant], nor do I have obligation [contract] with Andrew Goldberg. Andrew Goldberg is administering my Property without right.

 

20.    'This court has received your plea of NOT GUILTY to the above summary violation(s)". This statement is a blatant lie by its author; it constitutes Trespass, Forgery, Fraud, Barratry, and Identity Theft. I, a man...Alphonso-Nicholas Faggiolo did not, nor would I ever, plea to written instruments authored by other men and women [public servants]; which I have no obligation [contract] to acknowledge, believe, adhere.

 

21.    These three (3) sentences at (#21) constitute Trespass and unsolicited legal advice, in an unlawful attempt to coerce I, a man; to lower my Superior status of man, to that below a Judge [public servant]; in attempt to gain jurisdiction where none exists, nor can ever exist, as there is no Probable Cause, or verified Claim before this Administrative court; from any man or woman with Standing in any matter.

 

22.    "Failure to appear for your trial shall constitute consent to trial in your absence and if you are found guilty, the collateral deposited shall be forfeited and applied toward the fines, costs, and restitution". I, a man...Alphonso-Nicholas Faggiolo; am not owned by the author or anyone accepting responsibility [liability] for this false statement, nor do I have obligation [contract] with the author or anyone accepting responsibility [liability] for this false statement.
"You shall have the right to appeal within 30 days for a trial de novo": Further evidence that this is not, and cannot be a court of record, therefore is not a court of Pennsylvania [see paragraph 17], as "no fact tried by a jury, shall be otherwise reexamined [appealed] in any court of the United States, than according to the rules of the common law" [cf. Amendment 7 - Constitution for United States of America].

 

23.    "If you have any questions, please call the above office immediately". I, a man… Alphonso-Nicholas Faggiolo; have no obligation [contract] with public servants Acting as an "Office". In addition, this statement constitutes unsolicited legal advice, and all matters have already been addressed and resolved via an unrebutted Affidavit of Fact served on 10/2/2020 [7019 2970 0001 5737 9210] and Defaulted on 11/2/2020.

 

"Should you fail to appear for your summary trial, a warrant may be issued for your arrest". This statement constitutes Assault, Extortion, with threats to commit Battery, and Kidnapping. I, Alphonso-Nicholas Faggiolo, am a man. The alleged litigant is a Corporate FICTION [not real] which constitutes Fraud and Barratry. I, a man, have no obligation [contract] to Appear; and there exists no probable cause [crime] requiring an Appearance.

 

24.    The signature of Andrew Goldberg [public servant] evidences Trespass, Forgery, Fraud, Barratry, and Identity Theft. I am not Property of Andrew Goldberg [public servant]; and have no obligation [contract] with Andrew Goldberg. Andrew Goldberg possesses no personal jurisdiction of I, a man; nor subject matter jurisdiction of any matter concerning I, a man.

 

25.    In America, the courts of common law know no such distinction of symbols/seals, nor do symbols/seals confer distinction in law. It is needless to add, that as we are not encumbered by a nobility; there is no such distinction in America, as all men being equal in the eye of the law.
